Look up the parcel on the county GIS map before you make an offer. City limits around Huntsville and Madison are irregular, and two lots on the same road can fall under different rules.

Unincorporated Madison County: no zoning, real codes

The county engineer's standing letter lists everything the county enforces outside city limits: the subdivision regulations, the building codes adopted by the Commission, and the flood damage prevention ordinance (Madison County Public Works). The inspection FAQ is blunter: there are "NO Zoning requirements" limiting projects, and building types "are not limited to specific zones nor any aesthetic features mandated" (county FAQ).

So a metal-sided barndo on five acres in Hazel Green is the county's business only as far as the building code goes. That doesn't mean anything goes: recorded deed restrictions in a subdivision can ban metal siding, set a minimum heated square footage or rule out "barn-style" homes. The county doesn't enforce those, but neighbours and HOAs can, in court. Read them before you buy.

What a Madison County permit takes

The county enforces the 2018 International Residential Code with local changes (residential permitting). Applications go through the CityView portal and need:

  1. An address from the county Addressing office
  2. A sewer letter or a septic permit from the Madison County Health Department
  3. Full plans with a site plan, setbacks, easements and square footage split into heated, unheated and under-roof
  4. Sealed engineered drawings for post-frame/pole-barn and metal buildings, roof trusses and other systems outside the prescriptive code
  5. The builder's Alabama home builder licence, insurance certificate and state business licence (or an owner permit)

Inspections cover footings, under-slab plumbing, framing, exterior dry-in, rough-ins, energy compliance and final. A certificate of occupancy follows within two business days of a passed final.

County permit fees, worked out

Homebuilders' Academy fee (state)$20 per building permit

From the Madison County Residential Construction Resolution fee table.

Example (our math): a 2,000 sq ft home, a 1,200 sq ft shop and a 900 sq ft porch is 4,100 sq ft under roof, so about $697 for the building permit and about $480 for three trade permits on 3,200 sq ft under beam. Call it $1,250. Farm buildings built purely for agriculture need no permit for the structure unless they get electrical service, but a barn you live in is a house.

Inside Huntsville, Madison and the towns

City lots answer to city zoning. Huntsville's Residence 1 district, for example, calls for at least 15,000 sq ft and 100 ft of frontage, and caps buildings at 35% of the lot. Its special-exception rule for metal siding is written for non-residential buildings over 1,000 sq ft (ordinance, Zoneomics copy). We found nothing that bans a metal-sided house outright, but rules differ by district and by city. Call Huntsville Zoning (256-427-5100), the City of Madison or your town hall with the parcel number before you buy.

Near a city line, the city's subdivision rules can also reach up to five miles out when you split land (Ala. Code §11-52-30).

Limestone County

The county engineer told commissioners the county "does not hold statutory authority to establish zoning regulations" outside its towns (News Courier, June 2025). In 2023 commissioners discussed adding building permits and took no action; the only county oversight then was subdivision regulation (News Courier, June 2023). We found no later adoption. Even with no county inspector, your lender, your insurer and a future buyer will want a home built to code, and the septic permit is still required.

Licences and owner-builders

Alabama requires a home builder licence for residential work for someone else over $10,000 ($2,500 for roofing), and says nothing stops a person from building "on his or her own residence" (Home Builders Licensure law, Oct 2025). Madison County issues permits only to a licensed contractor or the real owner or occupant, and can ask for proof the home is for your own use (county resolution). Ask the Board about the rules if you might sell soon after finishing.
